New York's Supreme Court Has Dismissed a Lawsuit Filed by Bitfinex, and Has Launched a Full-Scale Investigation

The New York Supreme Court ruled and confirmed that the New York State Attorney General has "authority" in a dispute over jurisdiction between the New York State Attorney General and the virtual currency exchange Bitfinex, and allowed the New York State Attorney General to continue his investigation.

Bitfinex has claimed that it did not operate in New York, but the justice minister of New York state has argued that the IP addresses of users are evidence of New York operations.

In contrast to New York's state justice minister's argument that it is premature to bring up jurisdiction during the investigation, the Supreme Court said that "based on evidence and appropriate laws, the top court has the authority (clearly legal obligation) to hold the trial. At the same time, Bitfinex rejected claims that the top court in New York had no jurisdiction.

This would allow the New York Stock Exchange to continue its investigation into the Bitfinex exchange for fraud and misleading investors.

Meanwhile, New York's attorney general initially began to mislead investors in New York, claiming that BitFinex and related stable Coin Tether made up for $850 million in losses.

Since then, additional "right to control" issues have recently emerged as a major issue in the case. The legal representatives of Bitfinex and Teter have previously submitted documents to the court that neither company in New York, which has a particularly strict regulatory regime on decoding, has provided services to customers.

But Bitfinex's claim that it did not serve New York-based customers was further complicated by reports that U.S.-based users were still able to access the platform by lying about pop-up queries about their geographic locations.
